Terms of Service

These terms apply to the PulseESM website, API, and mobile app (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.

Beta service

PulseESM is in beta. Features may change, and the Service may occasionally be unavailable. We recommend exporting study data regularly.

Accounts

• You must give accurate information and keep your password and API keys confidential.
• You are responsible for activity under your account.
• You must be at least 13 years old to create an account.

Researchers

• You are responsible for your studies, including obtaining any required ethics or IRB approval, obtaining informed consent from participants, and following the laws and institutional rules that apply to your research.
• Collect only the data your approved protocol allows, and do not use the Service to collect data from participants without their consent.
• You are responsible for the compensation terms you offer participants and for honoring them.
• You own your study content and the data collected in your studies. You give PulseESM permission to store and process it only as needed to provide the Service to you.

Participants

• Taking part in any study is voluntary, and you may stop at any time. Each study is run by its researcher, not by PulseESM.
• Compensation, if any, is set by each study. Payouts are made according to that study's terms and may be withheld for responses that are fraudulent, automated, or duplicated.
• Please answer honestly and use only one account.

Acceptable use

Do not:

• break the law or violate others' rights using the Service;
• interfere with or overload the Service, or try to access data you are not authorized to see;
• submit fraudulent, automated, or duplicate responses;
• resell or share API access without our permission.

We may suspend or close accounts that violate these terms.

Fees

The Service is currently free during beta. If we introduce paid plans, prices and billing terms will be shown before you buy, and you will not be charged without agreeing to them.

Ending your use

You may stop using the Service at any time. Participants can delete their account in the app (Profile, Delete Account); anyone can also ask us to delete their account by emailing [email protected].

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, to the extent the law allows. We do not guarantee that the Service will be uninterrupted or error-free, or that data will never be lost.

Limitation of liability

To the extent the law allows, PulseESM will not be liable for indirect, incidental, special, or consequential damages, or for lost data or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or $100 if you paid nothing.

Changes

We may update these terms. If we do, we will update the date above, and continuing to use the Service means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of California.
